FAQ on the subject of sea freight

What does VATOS mean for sea freight offers?

VATOS stands for “Valid at Time of Shipment” and describes that the prices contained in the offer are confirmed at the time of shipment. As there may be sudden surcharges in maritime transport (for example in the high season or in the event of port congestion), the shipping companies reserve the right to impose these surcharges even after the offer has been confirmed.

The peak season is the peak season in maritime transport, when demand rises sharply, for example before holidays such as the Chinese New Year. During this time, freight rates are high and transport capacity is often scarce, which can lead to price increases and longer delivery times.

Incoterms (International Commercial Terms) are international trade terms that define who bears which costs, responsibilities and risks during transportation. Popular Incoterms for sea freight are:

EXW (Ex Works): The buyer assumes all transport costs and risks from the seller’s location.

FOB (Free On Board): The seller bears the costs and risks until the goods are loaded onto the ship, after which the buyer assumes them.

CFR/CIF (Cost and Freight / Cost, Insurance and Freight): The seller bears the costs up to the buyer’s port of arrival; CIF also includes transportation insurance.

DAP (Delivered at Place): The seller delivers the goods to the destination and assumes all transportation costs and risks up to that point.

The Bill of Lading is a negotiable instrument and at the same time a consignment note that contains important information about the freight, such as the sender, recipient and description of the goods. It serves as proof of shipment and as a document of ownership with which the owner can take possession of the goods. It can also be transferred to other parties if required.

These terms describe whether the cargo fits into the standard dimensions of a container:

In gauge means that the goods remain within the container dimensions and fit completely into the container.

Out of gauge describes loads that protrude beyond the edges of a container. Special container types such as open top or flat rack are often used for such oversized goods.

In maritime transport, there are force majeure clauses that apply in exceptional situations such as natural disasters, strikes, accidents or political conflicts. In these cases, liability is determined in accordance with the provisions of the ADSp (German Freight Forwarders’ Standard Terms and Conditions) or the IATA/FIATA. These regulations determine how damages and costs are apportioned and whether a claim for compensation exists.
Various container types are available depending on the type of cargo. In addition to standard containers (20’DV, 40’DV, 40’HC), there are reefer containers for temperature-controlled goods, open top containers for particularly high goods and flat rack containers for oversized or unusual loads.
