2. purpose and legal basis

We process personal data that we receive or collect from you as part of the application process or the employment relationship. In certain cases, we also collect data from other sources. Unless otherwise stated, all data is processed on the basis of § 26 BDSG. Without the provision of this data, it is not possible to process applications or subsequently manage the employment relationship.

We process the following categories of personal data:

  • Driver’s license data
  • Location data of the vehicles

The personal data concerning you will be processed for the following purposes on the following legal basis:

  • We process your personal data for as long as is necessary to make a decision about your application. If an employment relationship between you and us is not established, we may continue to store data if this is necessary to defend against possible legal claims. The application documents will be deleted no later than six months after notification of the rejection decision, unless longer storage is required due to legal disputes or you have given your consent.
  • We process your personal data that is necessary for the performance of the employment relationship. This is done in particular for the purposes of personnel administration and payroll accounting. The data is stored for the duration of the employment relationship and after its end until the expiry of the statutory retention period. In addition, we store the data required for an obituary.
  • We process driving license data and data on drivers’ driving times and rest periods in order to comply with legal obligations. This is done in particular for the purpose of fulfilling the legal regulations on the transportation of goods. The data is stored until the expiry of the statutory retention period under the Driving Personnel Act.
  • We process location and condition data of our vehicles within the scope of our legitimate interest in accordance with 6 para. 1 lit. f GDPR to monitor, control and optimize our vehicle fleet and to comply with legal obligations under Art. 6 para. 1 lit c GDPR . As we know which driver uses which vehicle, we can also deduce the location of the employee concerned. This data is stored for the duration of vehicle use.
  • We use data on driving style to reward employees who drive particularly economically. This processing is carried out in the interests of the drivers and on the basis of their consent in accordance with 6 para. 1 lit. a GDPR . If you do not give us your consent, you will not be able to benefit from the bonus system.

3. recipients of personal data

We only pass on your data to third parties if this is necessary to fulfill the purpose. Furthermore, data is passed on on the basis of legal regulations in accordance with Art. 6(1)(c) and (e) GDPR to authorities and social insurance institutions.

Mönig Holding GmbH performs various accounting and administrative tasks for us as our parent company. Data is transferred to the parent company on the basis of our legitimate interest in accordance with Art. 6(1)(f) GDPR to simplify processes within the Group.

In addition, we use processors in various cases in accordance with Art. 28 GDPR, who may receive data from us or have access to your data in connection with their services.
